Pursuant to Family Law Section 4-507 (a) A protective order may be modified or rescinded during the term of the protective order after:
The requesting party (1) Giving written notice to all affected persons eligible (2) Signing a waiver of tort claim of civil liability against the individual who requested the protective order and (3) The Court Scheduling a Hearing.
In deciding whether to shield a record of a protective order, the court shall balance the privacy of the petitioner or the respondent and potential danger of adverse consequences to the petitioner or the respondent against the potential risk of future harm and danger to the petitioner and the community.
