Courts usually encourage parents to determine a custody access schedule that serves the best interest of the child or children. School calendars include information about when the students are off. For example, in Montgomery County Public Schools, this year’s Winter break begins on December 23, 2024, and ends on January 1, 2025.
In custody matters parents generally prefer to divide the holiday with one parent having the first half and the other parent having the second half of the holiday period. If the parents live in the same area, it’s easier for them to split holiday access with their child or children. If the parents live a great distance form one another, it’s more difficult to equally divide their holiday access.
It’s in the best interest of the child to spend as much time during their breaks from school with each parent as possible. Planning for access in advance is always ideal.
A parenting plan is a very effective tool to determine specifics regarding holiday access. The following link is a sample parenting tool from Maryland Courts.
The courts in Montgomery County require parties to file their parenting tool in advance of a custody merits hearing.
